Man charged with the murder of Lohman while on a judicial order in prison

LAS CRUCES – A man accused of shooting another man on Lohman Avenue in August was arrested on Friday on the orders of a judge.

Hector Victor Calderon, 28, is charged with shooting and killing Eziekel Diaz, 40, on Lohman Avenue on August 16. In a press release, Las Cruces Police Department officials said they were looking for Jimmy Levi Rogers, 29, who also accused of killing Diaz. Calderon was arrested on September 4th on an arrest warrant.

Court records suggest Calderon and Rogers had a longstanding feud with Diaz. In an affidavit, Las Cruces Police Detective Frank Torres said a car that matched the description of Roger’s car stopped next to Diaz on Lohman.

The car waits about six seconds before pulling away, leaving Diaz outside of the car before collapsing to the ground. All of this was captured by a security camera from a nearby store.

In addition, Torres said in the affidavit that a forensic analysis of Calderon and Rogers’ cell phones shows that they were on Lohman Avenue at the time of the shooting. Additional footage from a surveillance camera showed Calderon and Rogers in a nearby fast food restaurant in Roger’s car shortly before the shooting.

Torres was testified as a witness during Friday’s pre-trial detention hearing. He said he believes Calderon was the shooter and Rogers the driver.

Third District Judge Douglas Driggers ordered that Calderon stay in jail immediately after Torres testified. The hearing lasted only 15 minutes.

In the prosecution’s motion to arrest Calderon, they cited the violent nature of the alleged incident and Calderon’s previous criminal convictions. Calderon was released from parole on the day of the shooting, according to the motion. He had served a prison sentence for theft shortly before the shooting.

Calderon was scheduled for a preliminary hearing on September 17th.
