Police Shooting Involving Santa Fe County Sheriff’s Office

Santa Fe District On Thursday, September 16, 2021, the New Mexico State Police Investigative Bureau was contacted to investigate an officer involved in a shootout with the Santa Fe County Sheriff’s Office.

Agents learned that around 2:00 p.m., the Santa Fe County Sheriff’s Office responded to an armed person barricaded in the Allsup’s restroom on Avenida Del Sur and New Mexico Highway 14 in Santa Fe, NM. The gunman was an employee of the Allsup’s. When the MPs arrived, they met the male subject armed with a firearm on an embankment south of the shop. When MPs tried to speak to the male subject, he fired a shot in the air. The MPs withdrew to a safe distance and called for help. The Santa Fe County’s SWAT team responded to the scene. When the SWAT team tried to negotiate a safe surrender, the male suspect, still armed with the gun, tried to evade MPs. A deputy fired a shot and hit the male subject.

The male subject, identified as Marvin Montoya, 39, from Santa Fe, NM, was rushed to a local hospital to be treated for his injuries. After his release, Montoya will face criminal prosecution.

The name of the deputy involved will only be announced after the interviews have been completed. No MPs were injured in the incident. Please contact the Santa Fe County Sheriff’s Office for any administrative questions regarding the alternate.

Agents of the New Mexico State Police Investigations Bureau are working to independently determine the series of events that led to the shooting, including gathering evidence and conducting interviews. Throughout the process, the results of the investigation are communicated to the District Attorney for review and consideration. The New Mexico State Police acts solely as a fact finder in their cases and does not determine whether an officer’s actions in these type of matters were warranted. This decision rests with the public prosecutor’s office.
