Potholes in Texas lead to a million dollar settlement for Las Cruces man

LAS CRUCES – Manuel Medina was stuck in his rolled over car for two hours before he was finally rescued.

When help came to Medina, who crashed on U.S. Highway 180/62 east between El Paso and Carlsbad about three years ago, first responders found his injuries, his lawyers said. He was flown to a hospital in El Paso, where doctors performed emergency surgery to keep Medina from becoming paralyzed.

The cause of the crash were two potholes that the Texas Department of Transportation had known about for months, according to court records. On November 18, a Hudspeth County jury awarded Medina a settlement of $ 1.59 million.

According to Medina attorney James Tawney, Texas law is a roof over the dollar amount of civil settlements. Medina receives $ 250,000 for the incident.

“We had a great client who was a hardworking man and was a member of our community before everything was stolen from him,” said Tawney. “Hopefully this ruling will change the way TXDOT prioritizes driver safety so what happened to Mr. Medina never happens to anyone else.”
